1. General Terms

You agree that you will respect all applicable laws and regulations and you will not use the website in any way that could impair the performance or overall functionality of the website.

 

2. Orders

We will accept your order subject to the present general terms and conditions of sale.

2.1 You can place an order in one of the following ways:

2.2 All our products are made to order. We will give you an estimated time of when your order will be ready for dispatch when we confirm your order. This estimate is not inclusive of delivery time.

2.3 Minimum order quantity for our wall covering is one roll, which comes in 10 metres length as an average roll length.

2.4 As part of our checkout process you will be given the opportunity to check your order and to correct any errors. We will send you an order acknowledgement, detailing the products you have ordered.

2.5 When a customer sends us an order we may accept it by sending the customer an order confirmation or by delivering the goods ordered.

2.6 We may refuse to accept an order:
(a) where goods are not available;
(b) where we cannot obtain authorisation for your payment;
(c) if there has been a pricing or product description error; or
(d) if you do not meet any eligibility criteria set out in our terms and conditions.

 

3. Pricing

3.1 Product prices are given in pounds sterling, inclusive VAT (where applicable) at the current rates. We reserve the right to express the price exclusive of VAT, but we shall show VAT separately and include it in the total price. Product prices shown are exclusive of postage and packaging, and any insurance costs. Unless stated otherwise.

3.2 For all consignments to be shipped outside of the UK, any customs duties, other local taxes, import duties or state taxes that may apply are your sole responsibility and are not payable by Moody Monday.

3.3 All orders are payable in pounds sterling.

3.4 Moody Monday reserves the right to change its prices at any time, although products will be invoiced at the price in effect when the order was placed, subject to availability. Information relating to prices and product availability is liable to change and is given by way of indication only.

 

4. Payment

4.1 Full payment is required upon placed order on any products supplied by Moody Monday. Work will not commence on any order until the full payment is received.

4.2 Our current accepted method of payments are cash, cheques, and PayPal. Any credit/ debit card payments can be made securely through PayPal. You do not have to register in order to make a payment through PayPal. Neither PayPal or Moody Monday stores any payment details on our system/ databases. In the case of payments by cheques, we will need to receive the fully cleared payment before any work commences.

4.3 Trade customers with accounts will be invoiced the full amount of any order following delivery of the goods. The customer will pay invoices within 30 days from the invoice date. All sums due from the customer, which remain unpaid after the due date for payment, shall accrue interest in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 until the outstanding amount is paid in full.

 

5. Cancellation, Changes, Returns, and Refunds

5.1 As all our products are made to order, the customer may not cancel any orders once placed.

5.2 Under exceptional circumstance and subject to acceptance by us, cancellation will only be accepted by us in writing and on condition that all costs and expenses incurred by us up to the time of cancellation, and all loss of profits and other loss or damage resulting to us because of the cancellation will be reimbursed to us by you forthwith.

5.3 Any changes to the customer’s order are subject to acceptance by us and, if appropriate, to payment of an additional processing fee. Unless we agree otherwise, no changes can be made to any orders once work has commenced on that order.

5.4 Customers are responsible for examining the goods on delivery. Any claim in respect of faulty orders must been made within 14 days from the delivery date. We shall not be liable for goods whatsoever once or if the goods have been cut or altered in any way.

5.4 For claims of faulty orders, we will offer you the option of a suitable replacement of the same or equivalent value, or refund you the full cost of the order including the delivery cost incurred. This will happen once we have received the faulty goods and are satisfied of the claim upon receipt and inspection of the returned goods.

5.5 In the case of refunds, we will refund any monies due to you back to the initial method of payment.

 

6. Delivery

6.1 Dates communicated by us are mere estimates. Accordingly, although we will use our reasonable efforts to meet estimated delivery times, under no circumstances shall we be liable for late delivery. Where reasonable, we may make partial deliveries and send the customer a partial invoice and the customer shall accept such partial delivery.

6.2 Delivery will be to the address identified to us by the customer and will be delivered from our designated address. The Goods (in part of in full) are at your risk from the time of delivery, even if we have arranged delivery to another venue for you. The customer is responsible for loss or damage to the goods once delivered and must pay any ongoing shipping and insurance charges. We will own all title to the goods delivered until the customer has paid us in full (in cash or cleared funds) all sums due to us in respect of such goods. Until such time, the customer shall hold goods on a fiduciary basis as our bailee.

6.3 Due to the manufacturing process there may be some variation in colour and print, this is due to the nature of the work as each design is printed by hand. If a large order is placed the customer must request that the order is fulfilled from a single batch to avoid any variation in colour.

7.1 The content of this website is the copyright of Moody Monday. By using the website you agree to respect the intellectual property rights of Moody Monday.

7.2 All text, notes, illustrations, designs, logos, and images reproduced by Moody Monday are the copyright of the author and are protected by intellectual property law worldwide. In accordance with the provisions of Intellectual Property legislation, you are permitted to print or copy materials from this website for non-commercial use, noting that copies of these materials must retain copyright. Other uses of the information are not authorised without prior written consent from Moody Monday and is an infringement of the author’s copyright and a violation of intellectual property rights.

 

8. Service Access

8.1 While we endeavour to ensure that this Website is normally available 24 hours a day, we will not be liable if for any reason this Website is unavailable at any time or for any period.

8.2 Access to this Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control.

 

9. Registration

9.1 To register with www.moodymonday.co.uk you must be over eighteen years of age.

9.2 Each registration is for a single user only. We do not permit you to share your user name and password with any other person nor with multiple users on a network.

9.3 Responsibility for the security of any passwords issued rests with you and if you know or suspect that someone else knows your password, you should contact us immediately.

9.4 We may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these terms and conditions.

Moody Monday cannot be held responsible in the event of force majeure, political upheaval, total or partial strike action affecting in particular postal services, transportation and/or communications services, flood and fire.
